Inheritance Law and the Continuity of Private Property

Today, just as the concept of private property is important, the rules of inheritance law that regulate to whom and how this property will pass after death hold great significance. Inheritance law is the branch of law that governs how the active and passive assets, as well as other legal relations of the deceased, will be transferred.

The distinction between active and passive plays a critical role here; under the principle of universal succession accepted in the Turkish legal system, heirs inherit both the estate and any debts of the deceased and are personally liable for these debts. Additionally, the question of who the heirs are is important; Turkish law applies the class system (zümre sistemi) of Germanic law origin, adopted from legal systems such as Swiss and German law.

The right to inheritance is constitutionally guaranteed. Article 35 of the Constitution of the Republic of Turkey states: "Everyone has the right to property and inheritance, but these rights may be restricted by law for the public interest." Accordingly, the Turkish Civil Code contains comprehensive regulations regarding inheritance law.
